Legal Mechanisms for Acquiring Ownership of Objects: Analyzing the Indonesian Civil Code and the Basic Agrarian Law

Abstract


This paper explores the legal pathways for acquiring property under Indonesian civil law, with a particular focus on the Civil Code and Law Number 5 of 1960, the Basic Agrarian Law (BAL). Using a normative legal research methodology, the study analyzes statutory provisions, judicial interpretations, and practical applications, aiming to clarify the legal mechanisms of property acquisition, including through contractual agreements, inheritance, and state grants. The paper highlights the distinctions between movable and immovable property and the absolute material rights associated with ownership. It also examines the BAL's impact on land ownership, emphasizing the state's role in regulating land use and the formal registration process for land transfers. Tensions between the Civil Code and the Basic Agrarian Law, particularly regarding customary land rights, are identified as key challenges in the current legal framework. The study concludes by proposing recommendations for legal clarity and reform, contributing to a deeper understanding of property law in Indonesia and offering insights for legal practice and policy development
