FOREST AREA ENFORCEMENT BY THE STATE IN THE PERSPECTIVE OF ENVIRONMENTAL JUSTICE

Abstract


The Indonesian government has highlighted the potential for forest damage to cause state and environmental losses. As a concrete effort, Presidential Regulation Number 5 Year 2025 concerning Forest Area Enforcement was issued to accelerate the process of regulating and reorganizing forest governance to regain control of forest areas by the state for the greatest prosperity of the people. However, these regulatory instruments are not free from various problems, especially in fulfilling the concept of environmental justice. The research method uses a normative juridical method using 2 (two) approaches, namely the statutory regulatory approach and the conceptual approach. The results of the study indicate that Presidential Regulation Number 5 Year 2025 concerning Forest Area Enforcement can reflect the direction of legal politics in reorganizing forest areas as stated in Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia, while the implementation of the concept of environmental justice in Presidential Regulation Number 5 Year 2025 concerning Forest Area Enforcement has not yet been fully realized, where the indicators of distributive justice, procedural justice, and social justice have not been fulfilled.
