Validity of Sharia Deeds Made by Non-Muslim Notaries and Attended by Non-Muslim Witnesses
Abstract
This study discusses the validity of sharia deeds made by non-Muslim notaries and attended by non-Muslim witnesses from the perspective of Indonesian positive law and sharia legal principles. This issue is important considering the increasingly complex development of notarial practices, especially in the preparation of deeds based on sharia principles, while the laws and regulations governing the position of notary do not explicitly require a particular religion for notaries or witnesses in the preparation of deeds. This study aims to analyze the validity of these sharia deeds reviewed from the provisions of applicable laws and regulations and from the perspective of Islamic law. The research method used is normative legal research with a statute approach, a conceptual approach, and a comparative approach. The legal materials used consist of primary legal materials in the form of laws and regulations related to the position of notary and sharia principles, as well as secondary legal materials in the form of literature, journals, and opinions of legal experts. A qualitative analysis was conducted to assess the conformity between positive legal provisions and Islamic legal principles regarding the formal and material requirements of a sharia deed. The results indicate that under Indonesian positive law, the validity of a deed is determined by the fulfillment of formal and material requirements as stipulated in laws and regulations concerning the office of notary, without any religious requirements for notaries or witnesses. However, from an Islamic legal perspective, there are differing opinions among Islamic scholars regarding the status of non-Muslim witnesses in certain sharia transactions. Therefore, the validity of a sharia deed drawn up by a non-Muslim notary and attended by non-Muslim witnesses remains legally valid as long as it meets the provisions of the laws and regulations. However, normatively, under Islamic law, this can be controversial depending on the type of contract and the interpretation of Islamic law.
