Consensus Deliberation (Musyawarah Mufakat) as the Philosophical Foundation of Mediation in Dispute Resolution in Indonesia: A Pancasila Legal Philosophy Perspective

Abstract

This study examines musyawarah mufakat (deliberative consensus) as the philosophical foundation of mediation in dispute resolution in Indonesia from the perspective of Pancasila legal philosophy. Although mediation has become an integral part of Indonesia's dispute resolution system, its implementation has frequently been understood merely as a procedural mechanism rather than as the embodiment of the philosophical values underlying the national legal system. This research aims to analyze the philosophical, juridical, and sociological foundations of musyawarah mufakat, evaluate its integration into Indonesia's mediation framework, identify the challenges encountered in its implementation, and formulate recommendations for strengthening mediation based on Pancasila values. This study employs normative legal research (doctrinal legal research) using statutory, conceptual, and philosophical approaches. The analysis is based on the 1945 Constitution of the Republic of Indonesia, Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, Law Number 48 of 2009 concerning Judicial Power, Supreme Court Regulation Number 1 of 2016 concerning Court-Annexed Mediation Procedures, and relevant legal doctrines and scholarly literature. The findings demonstrate that musyawarah mufakat possesses strong philosophical legitimacy as a manifestation of the Fourth Principle of Pancasila while also reflecting Indonesia's long-standing socio-cultural tradition of resolving disputes through deliberation and consensus. Existing legislation has incorporated the principle of deliberation into mediation procedures; however, significant challenges remain regarding the absence of substantive standards for implementing Pancasila values, limited mediator competencies, inadequate protection of vulnerable parties, and insufficient institutional oversight. Accordingly, this study recommends regulatory reform to explicitly integrate the principles of musyawarah mufakat into mediation procedures, strengthen mediator competency through Pancasila-based training, establish independent monitoring mechanisms, expand public legal education, and promote evidence-based policy development through empirical research. The study concludes that strengthening mediation based on musyawarah mufakat would reinforce Indonesia's dispute resolution system by harmonizing legal certainty, substantive justice, social harmony, and the constitutional values embodied in Pancasila.
