Trafficking in Persons (TIP) is a transnational organized crime that has become increasingly complex and cross-border in nature, with women and children as the most vulnerable groups exposed to exploitation. The complexity of this crime lies not only in the structured and profit-driven modus operandi of trafficking syndicates operating within a global economic framework, but also in the inherent limitations of national jurisdiction in reaching intellectual actors operating beyond territorial boundaries. This situation creates a significant enforcement gap when the principle of state sovereignty conflicts with the necessity of transnational human rights protection. This study employs a normative legal research method with statutory and conceptual approaches, based on library research of national and international legal instruments governing TIP and extraterritorial jurisdiction. The analysis is conducted using a qualitative-descriptive method to examine the effectiveness of extraterritorial jurisdiction and the practical obstacles in law enforcement, including limitations in extradition mechanisms and Mutual Legal Assistance (MLA). The findings indicate that although extraterritorial jurisdiction provides a legal foundation for states to pursue TIP offenders across borders, its effectiveness remains heavily dependent on international cooperation, which is often hindered by differences in legal systems, the dual criminality principle, and slow diplomatic bureaucratic procedures. Conversely, more integrated cross-border cooperation models such as Joint Investigation Teams and real-time intelligence sharing have proven more effective in accelerating law enforcement responses. This study concludes that the optimization of extraterritorial jurisdiction must be accompanied by the strengthening of flexible, rapid, and agency-to-agency based international cooperation mechanisms in order to enhance the overall effectiveness of combating transnational human trafficking.Referensi
