Adaptive Cyber Law Reform in Addressing Technology-Facilitated Human Trafficking Against Women and Children: Towards an Enhanced Adaptive Cyber Law Framework

Abstract

The rapid proliferation of digital technologies and telecommunication networks has profoundly transformed transnational organized crime, particularly technology-facilitated human trafficking targeting vulnerable women and children. Traditional, physically anchored legal mechanisms are structurally inadequate for combating borderless, algorithm-driven cyber networks. This study employs a normative-empirical legal methodology to evaluate the systemic mismatch between rapid technological innovation and static statutory frameworks. The findings indicate that domestic legislation suffers from significant jurisdictional and substantive ambiguities regarding digital coercion, online grooming, and corporate intermediary liability. Furthermore, law enforcement agencies face severe technical constraints and cross-border cooperation delays in securing volatile electronic evidence. To address these vulnerabilities, this article proposes an enhanced adaptive cyber law framework that integrates proactive regulatory models, mandatory human rights due diligence for digital platforms, streamlined international cooperation, and comprehensive, victimcentric digital remediation rights.
