A New Paradigm of Exploitation Punishment: Assessing the Efficacy of the National Criminal Code in Dismantling Human Trafficking Syndicates

Abstract

The persistent evolution of human trafficking networks demands a highly robust and adaptable legal framework. With the updated Indonesian Criminal Code officially taking effect on January 2, 2026, a modernized approach to criminal prosecution has emerged. This study aims to examine the efficacy and the new paradigm of sentencing policies within this newly active National Criminal Code, specifically evaluating its capacity to dismantle human trafficking syndicates. A qualitative normative legal approach was employed in conducting the research, utilizing statutory analysis to assess the updated substantive criminal laws and law enforcement strategies. Based on the findings, it can be concluded that the newly implemented code effectively closes previous legal loopholes, providing law enforcement with sharper, more comprehensive instruments to prosecute organized exploitation networks and ensuring a more rigorous legal response to trafficking offenses.
