International Mechanisms and Methods Aimed at Combating Trafficking in Human Organs

Abstract

Trafficking in human organs has evolved into a sophisticated transnational organized crime, driven by a persistent global shortage of organs for transplantation, systemic socioeconomic vulnerabilities, and the high profitability of illicit medical markets. This paper examines the scope of international mechanisms, legal frameworks, and administrative methodologies designed to prevent, suppress, and prosecute the illicit trade in human organs. Through a comparative and analytical lens, the study evaluates the efficacy of key global instruments including the United Nations Palermo Protocol, World Health Organization (WHO) guiding principles, the Council of Europe Convention against Trafficking in Human Organs, and the Declaration of Istanbul. The findings indicate that while international standards have successfully prompted legislative harmonization and heightened criminal penalties across various domestic jurisdictions, significant enforcement gaps persist. These challenges stem from inadequate cross-border cooperation, difficulties in victim identification, complex intersections between medical tourism and illegal procurement, and the exploitation of digital platforms by trafficking syndicates. This study emphasizes that combating this global phenomenon requires a multi-layered approach: strengthening international legal frameworks, enhancing regulatory oversight of medical institutions, improving inter-agency and transnational law enforcement coordination, and prioritizing a human rights-based approach focused on victim protection and ethical domestic organ donation alternatives.
