Legal Frameworks for Insurance Disputes: Evaluating Policyholder Rights and Insurer Obligations in Emerging Markets

Abstract


Insurance disputes have become increasingly significant in emerging markets due to the growing complexity of insurance products, information asymmetry between insurers and policyholders, and challenges associated with claims settlement processes. These disputes often raise concerns regarding the adequacy of legal frameworks in balancing policyholder rights and insurer obligations while ensuring fairness, transparency, and legal certainty. This research aims to evaluate the effectiveness of legal frameworks governing insurance disputes in emerging markets by examining the relationship between policyholder rights, insurer obligations, and regulatory accountability within contemporary insurance law. The study employed normative legal research using a qualitative approach and library research methods. Data were collected through the examination of statutory regulations, international regulatory standards, scholarly literature, and legal doctrines related to insurance law, consumer protection, and dispute resolution. The analysis was conducted through content analysis, conceptual legal analysis, and comparative legal analysis to assess the strengths and weaknesses of existing legal frameworks. The findings indicate that insurance disputes are primarily influenced by information asymmetry, ambiguity in policy interpretation, deficiencies in claims handling procedures, and variations in regulatory effectiveness. Although current legal frameworks increasingly recognize policyholder rights and impose broader accountability obligations on insurers, significant challenges remain in ensuring effective implementation and equitable dispute resolution outcomes. This study concludes that effective insurance dispute resolution requires an integrated framework combining policyholder protection, insurer accountability, regulatory effectiveness, and accessible dispute resolution mechanisms. The novelty of this research lies in the development of a comprehensive analytical framework that integrates these four dimensions as interconnected pillars for evaluating and strengthening insurance dispute resolution systems in emerging markets.
