Renewal of Islamic Family Law Based on Maqāṣid Al-Syarī’ah: A Model of Family Protection in the Digital Era

Abstract


Digital transformation has changed family interaction patterns and given rise to various new legal issues, such as digital-based violence, privacy violations, child exploitation, online infidelity, and cybercrime, which have not been fully accommodated in Islamic family law. This study aims to analyze the relevance of the maqāṣid al-syarī’ah as a basis for reforming Islamic family law and to formulate a model of family protection that is responsive to the challenges of the digital era. The study uses a normative legal research method with a conceptual approach, a statutory approach, and a maqāṣid al-syarī’ah approach. Data sources were obtained through a literature review of the Qur’an, hadith, laws and regulations, and contemporary Islamic legal literature. The results of the study indicate that maqāṣid al-syarī’ah has strong relevance as a paradigm for reforming Islamic family law because it is oriented towards protecting the public interest through the principles of ḥifẓ al-dīn, ḥifẓ al-nafs, ḥifẓ al-’aql, ḥifẓ al-nasl, and ḥifẓ al-māl. The findings propose a five-pillar maqāṣid al-syarī’ah-based reform model: protecting digital rights, strengthening Islamic digital literacy, safeguarding children, regulating spousal digital rights, and securing family finances through safe, Sharia-compliant transactions.
