Criminal Responsibility for Perpetrators of Criminal Acts of Theft Within the Family Based on Positive Law
Abstract
This study aims to analyze criminal liability for perpetrators of theft within the family based on positive law, examine its weaknesses, and formulate an ideal criminal liability structure for the future. This research is motivated by the awareness that theft within the family has a different complexity than ordinary theft, thus requiring a normative approach that is more contextual and responsive to the social realities of Indonesian society. The research findings indicate that the National Criminal Code (KUHP) regulates criminal liability for perpetrators of domestic theft, with a number of normative specificities through a relative complaint mechanism. However, three weaknesses were identified: the general nature of the legal substance that fails to accommodate the nuances of family relationships; the disparity in decisions and the weak capacity of law enforcement officials; and a legal culture that remains retributively oriented. Integrative reforms are needed in the future, encompassing normative categorization of domestic theft and domestic theft, strengthening restorative justice mechanisms, increasing institutional capacity, and transforming the legal culture toward a more humanistic and recovery-oriented paradigm. This research is based on three main theories, namely the theory of criminal responsibility which emphasizes guilt as an absolute condition for punishment, the theory of the legal system of Lawrence M. Friedman which analyzes the effectiveness of the law through three components, namely legal substance, legal structure, and legal culture, and the theory of justice (Gustav Radbruch) which places the balance between justice, legal certainty, and utility as the highest ideals in a dignified legal system.
