The Role of The Police in Handling The Criminal Acts of Theft with Violence Based on The Provisions of Article 479 of The KUHP
Abstract
Indonesia, as a nation based on the rule of law, places the Indonesian National Police (Polri) as a key institution in law enforcement and public protection. One crime that requires serious attention is theft with violence, as stipulated in Article 479 of the Criminal Code (Law No. 1 of 2023), as it not only damages the victim's property but also threatens life and instills fear in the community. This study aims to analyze the role of the police in handling violent theft crimes. The research method used is normative legal research with a statutory and conceptual approach. The results indicate that the police have a strategic role, spanning prevention, enforcement, and investigation as part of the criminal justice system. However, its implementation still faces obstacles, such as limited resources, difficulty proving elements of violence, and high public demand for expedited case handling. This study concludes that optimizing the role of the police needs to be done through increasing professionalism, strengthening coordination between law enforcement agencies, and implementing the principle of due process of law in order to realize effective law enforcement, protect victims, and ensure substantive justice.
