Reformulation of the Death Penalty Policy in the National Criminal Code Based on Pancasila Justice Values
Abstract
This study aims to analyze the suitability of the death penalty policy in the National Criminal Code with the values of Pancasila justice, identify weaknesses and legal problems in its regulation, and formulate an ideal death penalty policy formulation to align with just and civilized humanitarian values and social justice. This study uses the Pancasila Justice Theory as the main theory combined with the theory of punishment and human rights theory in analyzing the death penalty policy in Indonesia. The research findings indicate that the death penalty policy in the National Criminal Code reflects relative conformity with the Pancasila values of justice through limitations on its application, the provision of probation, and its nature as a special and alternative punishment. Weaknesses identified include tensions with the right to life as a fundamental human right, unclear normative parameters, and potential disparities in its application. An ideal policy formulation positions the death penalty as a limited, conditional sanction, used very selectively as an ultimum remedium, while still prioritizing the principles of humanity, social justice, and a balance between protecting society and respecting human rights.
