Legal Responsibility of Perpetrators of Traffic Violations That Cause Victims to Die at the Barelang Resort Police
Abstract
Traffic accidents result in the death of people, including serious traffic accidents. Drivers involved in traffic accidents have an obligation to stop the vehicle they are driving, provide assistance to the victim, report the accident to the nearest police and provide information related to the accident. Every driver whose negligence causes a traffic accident must be responsible for the losses suffered by the victim. The objectives of this research are (1) To determine and analyze the legal responsibility of perpetrators of traffic violations that cause the victim to die at the Barelang Resort Police; (2) To find out and analyze the effectiveness of carrying out investigations into traffic violations that caused victims to die at the Barelang Resort Police.This research uses a normative juridical approach, with analytical descriptive research specifications. Secondary data comes from primary legal, secondary legal and tertiary legal materials, as well as legal expert sources. Data collection uses a mixed method of field data and literature. Data processing was carried out qualitatively, then conclusions were drawn using the inductive method. The research problem was analyzed using the Theory of Legal Responsibility according to Hans Kelsen and the Theory of Legal Effectiveness according to Soerjono Soekanto.
