Implementation of the Policy for Terminating Prosecution of Crimes of Narcotics Abuse Through a Restorative Justice Approach in the Republic of Indonesia Prosecutor's Regulations (Case Study at the Takalar District Prosecutor's Office)

Abstract


Narcotics abuse in Indonesia is in a very worrying condition, this is because currently Indonesian people have very easy access to narcotics. The situation is further aggravated by the fact that there has begun to normalize the illicit distribution of narcotics in public places, so that it is very damaging to people's lives, especially the younger generation. Narcotics abuse cannot be allowed to continue to grow because if narcotics continues to develop, it will not only damage the physical and psychological (mental) health of its users, but will also result in a slowdown in economic development and a decline in social progress. In the development of law in Indonesia, the policy of terminating prosecutions through a restorative justice approach is known. Of course, the emergence of restorative justice can provide protection for victims of narcotics abuse, who are not involved in illicit narcotics trafficking. The aim of this research is to find out what criteria a person can be categorized as a victim/addict/narcotics abuser according to Law Number 35 of 2009 concerning Narcotics and how to implement the policy of terminating prosecution for criminal acts of narcotics abuse through a restorative justice approach, especially in the Republic of Indonesia Prosecutor's Regulations. This research is empirical juridical research, which is qualitative in nature. Data collection techniques use library study and interview techniques. The results of the research conclude that the policy of terminating prosecutions for criminal acts of narcotics abuse with a restorative justice approach, especially in the Republic of Indonesia Prosecutor's Regulations, has now begun to be implemented and has had a positive impact in fulfilling society's sense of justice by balancing legal certainty and conscience.
