Formulation of Law Enforcement Against Illegal Mining Crimes

Abstract


This research aims to determine and analyze the current implementation of law enforcement against illegal mining crimes in the Riau Islands Police, the weaknesses of law enforcement against illegal mining crimes in the Riau Islands Police at this time and the formulation of the implementation of law enforcement against illegal mining crimes in the future. This research uses a sociological juridical approach, the research specifications are analytical descriptive, the data used is primary data and secondary data. The data collection methods are field studies and literature studies. The data analysis method used is qualitative. The theories used in this research are the theory of legal effectiveness and the theory of benefits. Based on the research results, it can be concluded that the current implementation of law enforcement against illegal mining crimes at the Riau Islands Regional Police is preventive (non-penal) and repressive (penal) law enforcement, but more repressive. The current weakness in law enforcement against illegal mining crimes in the Riau Islands Regional Police is that there is no appointment of expert witnesses from the center to the regions so that examination of expert witnesses takes a long time; the lack of forensic laboratories in each regional police unit (Polda Riau Islands); lack of legal awareness from the public. The formulation for implementing law enforcement against criminal acts of illegal mining in the future is to accommodate illegal mining into legal and licensed miners through guidance and supervision; prioritizing preventive law enforcement in illegal mining crimes, repressive law enforcement as an ulmimum remedium, and formulating sanctions for mining crimes. With this formulation, it is hoped that the implementation of law enforcement against illegal mining crimes will be more effective.
