The Effectiveness of Implementing Additional Crimes in the Form of Chemical Castration Against Child Sexual Offenders in the Criminal Justice System in Indonesia

Abstract


Sexual violence against children is a serious crime that is increasing from time to time and can significantly threaten and endanger children's lives, damage children's personal lives and growth and development, and disrupt the sense of comfort, peace, security and public order. Problems regarding how to regulate additional punishment in the form of chemical castration and the effectiveness of implementing additional punishment in the form of chemical castration against perpetrators of child sexual intercourse in Indonesia. The approach method used in this research is sociological juridical, the specifications of this research are analytical descriptive, the data sources used are primary data and secondary data. Primary data is data obtained directly from the field or from the first source and has not been processed by other parties. Meanwhile, secondary data was obtained from library research consisting of primary legal materials, secondary legal materials and tertiary legal materials. The author analyzes the research problems above using the Theory of Punishment, Theory of Legal Objectives and Theory of Legal Effectiveness. The research results show that additional criminal regulations in the form of chemical castration are regulated in Perppu Number 1 of 2016 jo. Law No. 17 of 2016, concerning Child Protection, especially Article 81 paragraph (7) which regulates actions in the form of chemical castration which reads "The perpetrators as referred to in paragraphs (4) and paragraph (5) may be subject to actions in the form of chemical castration and the installation of detection devices electronic". Then, regarding the effectiveness of the application of additional punishment in the form of chemical castration against perpetrators of child sexual intercourse, to date no data has been found to show the effectiveness of the application of additional punishment in the form of chemical castration.
