Criminal Law Policy in Efforts to Overcome Environmental Crimes Based on Religious Justice Values

Abstract


This article aims to discuss and understand criminal law policies in an effort to overcome environmental crimes based on religious justice values. This research uses a normative juridical research approach, which uses descriptive analysis methods. By explaining the problem which is strengthened by existing data and analyzing it through literature study. Based on research, it is concluded that the criminal law policy in an effort to tackle environmental crimes in the current legal provisions in Indonesia is Law Number 32 of 2009 concerning Environmental Protection and Management. A number of articles in Law No. 32 of 2009 regulate the legal provisions and framework for environmental protection and management. Law enforcement for perpetrators of environmental pollution and damage has been regulated in the form of sanctions as contained therein. Sanctions for perpetrators, both individuals and corporations, must be implemented through a thorough and thorough study according to the characteristics, objectives and benefits of implementing these sanctions. The imposition of criminal penalties on perpetrators of environmental crimes must pay attention to the values of justice based on God Almighty. The sanctions that are considered to be the most effective to apply to perpetrators of environmental crimes and in the context of enforcing environmental law are not only criminal sanctions, but also administrative legal sanctions in the form of sanctions freezing and/or revoking the business permits of every corporation that commits environmental crimes.
