Juridical Analysis Domestic Violence As A Reason For Divorce

Abstract

Acts of violence in the household generally involve perpetrators and victims among family members in the household, while forms of violence can take the form of physical violence and verbal violence (threats of violence). In marriage between husband and wife, disputes often occur which are often accompanied by violence by one of the parties and result in divorce. One of the reasons that causes divorce in Article 19 of Government Regulation Number 9 of 1975 is that one of the parties commits cruelty or serious abuse that endangers other people, when one of the parties victims of domestic violence can provide strong evidence in court and husband and wife can no longer live together in a household, then divorce can be carried out in a court session based on Article 39 paragraph (1) of the Law No. 16 of 2019.
