Legal Protection for Perpetrators of the Crime of Child Abuse Based on Sema Number 1 of 2017

Abstract


This research aims to determine and analyze current legal protection efforts for perpetrators of criminal acts of sexual abuse against children, the factors that cause weak legal protection efforts for perpetrators of criminal acts of sexual abuse against children, and ideal legal protection efforts for perpetrators of criminal acts of sexual abuse against children. This research approach method is normative juridical, descriptive analytical research specifications, and the type of data uses secondary data. The data collection method is library research, while the data analysis method is qualitative analysis. Based on the research results, it was concluded that legal protection efforts for perpetrators of criminal acts of sexual abuse against children based on SEMA Number 1 of 2017 are still weak. This is because the judge has the freedom to impose a sentence, The judge did not consider the peace agreement stipulated in SEMA No. 1 of 2017 even though it had been proposed in the plea. The ideal legal protection effort for perpetrators of criminal acts of sexual abuse against children is that judges must have broad insight by considering the existence of SEMA No. 1 of 2017 in their criminal decisions to provide legal protection for perpetrators of criminal acts.
