Fiduciary Dispute Resolution Through The Consumer Dispute Settlement Agency

Abstract


The purpose of this study is to determine the fiduciary dispute resolution mechanism through the consumer dispute settlement agency (BPSK). The approach method used is normative juridical. The results of the research obtained state that the resolution of consumer disputes is carried out in the form of a panel, meaning that consumer disputes are examined and decided by the BPSK assembly, with at least 3 (three) BPSK members as an assembly assisted by a clerk. In other words, examination of consumer cases is similar to examinations carried out by judges in court, therefore, this BPSK can be called a moot court (quasi court). The decision given by the BPSK panel in this consumer dispute is final (in kracht van gewujsde), binding, and cannot be appealed again. efforts to resolve consumer disputes through BPSK face problems including: the task is too complex because it functions as a consumer dispute resolution institution and includes guidance and supervision. There are no clear rules regarding budget allocations. Lack of human resources for BPSK members, and low legal awareness of consumers and business actors
