Abstract

Auction minutes provide authentic evidence of voluntary non-execution auctions and support legal certainty in payment, delivery, transfer of rights, and protection of auction participants. This article analyzes the legal construction of the authenticity and evidentiary force of auction minutes prepared by a notary acting as a Class II Auction Officer. The study employs normative legal research using statutory, conceptual, and analytical approaches to examine the Civil Code, notarial legislation, auction regulations, legal doctrines, and judicial decisions. The findings show that authenticity derives primarily from the special public authority of the Class II Auction Officer rather than merely from the notarial office. It requires compliance with competence ratione personae, ratione materiae, ratione loci, and ratione temporis, together with the prescribed form and procedure. As an ambtelijke akte characterized as a relaasakte, auction minutes possess external, formal, and material evidentiary force, although material force is limited to facts performed, observed, or witnessed by the Auction Officer. The article proposes a four-layer authenticity test covering official status, limits of authority, form and procedure, and scope of proof. This test distinguishes correctable clerical errors, fundamental formal defects, defects of authority, and procedural violations affecting auction validity.
