This study examines the role of Jordan's judicial institutions in environmental protection by analyzing the jurisdictions of administrative, criminal, and civil courts, as well as the influence of international environmental conventions. It aims to assess whether the current judicial framework delivers adequate environmental justice and identifies the absence of specialized environmental courts as a significant institutional gapage. Employing a normative legal methodology, the study reviews provisions within Jordan's Administrative Judiciary Law and Environmental Protection Law to evaluate the allocation of jurisdiction over environmental disputes and violations. The findings reveal that the handling of environmental cases is fragmented across administrative, criminal, and civil courts, resulting in inconsistent legal protection and limiting the effective enforcement of environmental rights. The study’s novelty lies in its comprehensive evaluation of Jordan's judicial structure from an environmental justice perspective and its proposals for institutional reform. The study concludes that the establishment of a specialized environmental court, staffed by judges with expertise in environmental law, would strengthen environmental protection, improve enforcement of environmental laws and regulations, and expand access to environmental justice in Jordan.Referensi
