The Urgency of Restitution as an Effort to Restore the Rights of Children as Victims of Sexual Violence in Semarang City
Abstract
The issue of vague regulations regarding restitution for child victims of sexual violence has resulted in the violation of their rights and justice. The approach used is a sociological juridical method, where law in this study is conceptualized as the ideas, culture, and views of society regarding legal regulations implemented in the social environment. Based on the research conducted, it is known that the implementation of protection and rehabilitation for child victims of sexual violence is ineffective. This is demonstrated by the minimal implementation of restitution for child victims of sexual violence, which ultimately hinders the rehabilitation of child victims of sexual violence. Another obstacle is the lack of clear and explicit legal regulations regarding the implementation of restitution. This culturally hinders the restitution system for child victims of sexual violence.
