Notary's Responsibility for Making Inheritance Certificates That Do Not Involve All Heirs

Abstract


This research aims to analyze: 1) The notary's responsibility for making inheritance certificates which do not involve all the heirs. 2) Legal protection for parties for making inheritance certificates that do not involve all heirs. The approach method used in this research is the empirical juridical approach method. This type of research includes analytical descriptive research. The types and sources of data in this research are primary data and secondary data obtained through interviews and literature study. The analysis in this research is qualitative. The results of the research concluded: 1) The notary's responsibility for making a certificate of inheritance that does not involve all the heirs can be subject to civil responsibility, criminal responsibility, responsibility in carrying out his position towards the notary and responsibility for the code of ethics. The responsibility of a notary in making a certificate of inheritance depends on what errors are in the Deed of Certificate of Inheritance made by the Notary. The notary's responsibilities are not limited to law alone, but can also take the form of moral and ethical responsibilities, so that when making a deed of inheritance information, if the Notary makes a mistake or takes an action that is detrimental to the parties or one of the interested parties, the notary is obliged to be morally and responsibly responsible. ethics or full responsibility. 2) Legal protection for parties for making inheritance certificates that do not involve all the heirs is that repressive protection can be obtained by other heirs through complaints through court lawsuits, both criminal lawsuits and civil lawsuits. Legal protection for heirs in disputes regarding the preparation of inheritance certificates which do not involve all the heirs, in addition to receiving repressive protection, actually also receives preventive protection. Preventive legal protection for holders of property rights to land is by registering the land.
