The Appointment of Soe’s in the Construction Sector by Fast-Tracking Development of Toll Roads Regulation
Abstract
In the year 2020 many obstacles and disadvantages to toll road infrastructure development has resurfaced. From this phenomenon here and there in 2020, PT. Waskita Karya (Persero) Tbk written down poor achievement which was marked by a net loss of IDR 7.38 trillion. The intention of this research is to study privatization of State-Owned Enterprises (SOEs) under “Persero” model. The objective of this study is to seek what factors cause obstacles and losses to such SOEs. The research method is normative juridical. The findings show that there are two types of SOE, one of which is privatized. The legal problem is there are private companies as a shareholder of the SOEs whilst the government responsible for the potential loss of the project. The government has had plans to build toll roads outside of Java, which include speeding up the construction of toll roads in Sumatra. In 2014 the President has given an assignment to such SOEs then creates various obstacles and losses for the Government. The conclusion of this research is how to reconstruct understanding upon SOEs, Public Private Partnership concept, as well as interpretation upon exclusion regarding SOEs under Monopoly and Unfair Competition Law.
