Legal Review Of Criminal Sanctions For The Illegal Sale Of Firearms Through E-Commerce Platforms (Case Study At The South Jakarta District Court)

Abstract


The crime of illegal sale of firearms is a serious crime regulated in Article 1 paragraph 1 No. 12 of the Emergency Law of 1951. Illegal sales through e-commerce such as Shopee and Tokopedia are increasingly common. Illegal firearms are obtained or sold without official permission by the perpetrators modifying air guns or airsoft guns into firearms. This poses challenges in supervision and law enforcement. The aspects of evidence, law enforcement, and e-commerce policies are determining factors in the legal process and criminalization of perpetrators.
This study aims to analyze criminal sanctions for illegal firearm sales through e-commerce, with a case study at the South Jakarta District Court. In addition, the study examines Shopee and Tokopedia's policies regarding firearm sales and efforts to improve these policies in supporting law enforcement based on Emergency Law No. 12 of 1951 and the ITE Law. The study uses a normative legal method through literature studies, laws and regulations, and court decisions. The results of the study show that criminal sanctions in case No. 1/Pid.Sus/2024/PN JKT.SEL are regulated in Article 1 paragraph (1) of Emergency Law No. 12 of 1951 with a maximum sentence of four years in prison. In case No. 2/Pid.Sus/2024/PN JKT.SEL, the perpetrator is threatened with a sentence of three to four years in prison according to Article 1 paragraph (1) of Emergency Law No. 12 of 1951 in conjunction with Article 55 paragraph (1) of the Criminal Code. E-commerce policies indicate platform responsibility but in practice tend to relinquish responsibility to sellers so that supervision is weak. An active role for e-commerce is needed in complying with legal obligations in order to create safe and orderly trade.
