Analysis Of Regional Regulation Making And Administrative Legal Procedures At The Office Of The Regional People's Representative Council Of Kota Baru District, South Kalimantan Province

Abstract

This study aims to analyze the administrative legal procedures in the process of forming Regional Regulations (PERDA) at the Regional People's Representative Council (DPRD) Office of Kota Baru Regency, South Kalimantan Province, as well as the obstacles faced in the preparation and ratification of REGIONAL REGULATION. In addition, this study also discusses public participation and transparency in the legislative process in the region. The method used in this study is a qualitative Juridical Sociological approach with in-depth interviews with DPRD members, Regional Heads, and other related parties involved in the legislative process. The results of the study indicate that the procedure for forming PERDA in Kota Baru Regency follows the stages that have been regulated in the legislation, starting from the planning of the PERDA formation program, the preparation of the PERDA draft by the DPRD and Regional Head, discussion in the DPRD, to ratification. However, there are several technical obstacles, such as limited legal resources and academic manuscripts that affect the quality of PERDA preparation. In addition, communication and coordination between the DPRD and the Regional Head are also challenges that need to be improved to ensure a smooth legislative process. In terms of public participation, although there has been a public consultation mechanism, public participation in the legislative process is still limited by low socialization and accessibility of information. Therefore, further efforts are needed to increase transparency and public involvement through the use of information technology and social media. This study suggests that human resource capacity, coordination between institutions, and public participation have been improved in order to facilitate the process of forming PERDA that is more accountable and beneficial to the community.
