Juridical Analysis of Electronic-Based Sexual Violence Crimes

Abstract


In the current era, technology is something that is really needed by every group, the use of technology brings positive forms to facilitate communication and so on, but the use of technology is widely misused, such as electronic-based sexual violence which is regulated in Law Number 19 of 2016 concerning Information and Electronic Transactions and Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence. The aim of this thesis research is to synchronize these two regulations and how to enforce the law against perpetrators of electronic-based sexual violence crimes.               The method used is a normative juridical approach. With research specifications using normative descriptive, which uses secondary data analyzed qualitatively. The problem formulation is analyzed on the basis of legal certainty theory and law enforcement theory.               The results of the research show the synchronization of two regulations regarding Electronic-Based Sexual Violence Crimes which are regulated in Article 27 Paragraph (1) of Law Number 19 of 2016 concerning Electronic Information and Transactions and Article 14 of Law Number 12 of 2022 concerning Sexual Violence Crimes, where the TPKS Law does not specifically regulate electronic-based sexual violence, but the TPKS Law regulates things that are not in the ITE Law. Then law enforcement, KSBE perpetrators according to the TPKS Law will be sentenced to imprisonment for a maximum of 4 (four) years and/or a fine of a maximum of IDR 200,000,000.00 (two hundred million rupiah). And the ITE Law in article 27 paragraph (1) provides a maximum prison sentence of 6 (six) years and a maximum fine of IDR 1,000,000,000 (One Billion Rupiah). In this case, the ITE Law has a higher penalty period and fine compared to the TPKS Law, but the TPKS Law exists in order to provide guarantees for prevention, protection, access to justice and recovery, as well as comprehensive fulfillment of victims' rights. which so far has not been found in the ITE Law.
