Faradina Mar’atus Shofia, Andri Winjaya Laksana

Abstract

This research aims to find out how the post-divorce rights of wives are imposed, namely Mut’ah and Iddah living in divorce cases based on the value of justice. This research uses two approach methods, namely normative legal research and empirical legal research with research specifications that are descriptive analysis. The author collected data using documentation studies (library materials) and interviews. Then the data obtained, both from literature studies and from interviews, will be analyzed descriptively qualitatively. Based on research, it is concluded that ex-wives can still claim Mut’ah and Iddah maintenance in divorce cases, both in cases of talak divorce and contested divorce, even though there are several things that are not regulated in statutory regulations.
