Criminal Liability of Offenders Driving Motorized Vehicles Causing Traffic Accidents

Abstract


This research was conducted to find out how the criminal responsibility of the driver of the vehicle that resulted in death in a traffic accident and whether the crime of traffic accidents resulting in death in the future in the formation of the National Criminal Code still needs to be maintained. By using the literature research method it can be concluded: 1. The criminal responsibility of a vehicle driver resulting in death in a traffic accident in Article 359 of the Indonesian Criminal Code is a maximum imprisonment of five years or a maximum imprisonment of one year, criminal sanctions may also be imposed as regulated in Article 310 Law No.
