Responsibilities of Land Deed Drafting Officials (PPAT) for Making Deeds of Sale and Purchase of Joint Property Objects Transferred Without Wife's Consent

Abstract


This research aims to analyze: 1) The legal consequences of making a deed of sale and purchase of joint property objects that are transferred without the wife's consent. 2) Responsibility of the land deed maker (ppat) for making sale and purchase deeds of joint property objects that are transferred without the wife's consent. The approach methods used in this research are the case study approach and the statutory approach. This type of research is qualitative research. The type and source of data in this research is secondary data obtained through literature study. The analysis in this research is qualitative. The results of the research concluded: 1) The legal consequences of making a deed of sale and purchase of joint property objects that are transferred without the wife's consent are invalid or null and void, because the making of the deed of sale and purchase before the PPAT was not based on honest intentions. This also resulted in PPAT being involved in unlawful acts. A sale and purchase deed that is declared to have no binding legal force results in the deed becoming a sub-land deed, and the sale of the land becomes invalid or null and void. This causes losses for the parties, especially in this case the Buyer. By canceling the sale and purchase transaction, the sale and purchase transaction is deemed to have never occurred so that the status of the land should return to its original state. 2) The responsibility of the land deed maker (PPAT) for making the sale and purchase deed of joint property objects that are transferred without the wife's consent is an absolute responsibility due to the fact that the PPAT was not careful and careful in making the sale and purchase deed. As stated in Article 1366 of the Civil Code, every person is responsible not only for losses caused by his actions, but also for losses caused by his negligence or lack of care. By declaring the sale and purchase deed contrary to the law, it will cause losses to the buyer, so that PPAT must take responsibility for the material losses suffered by the parties.
